Late Wednesday the Orange County Sheriff’s Department released a statement:
Since the day the Orange County Sheriffs Office learned of the disappearance of Caylee Marie Anthony, the paramount concern has been to locate this child and to shed light on her disappearance.
Throughout this investigation the Orange County Sheriffs Office investigators have followed up on thousands of leads and continue with this daunting challenge. Investigators have continuously worked diligently with the FBI, FDLE, the Orange County State Attorneys Office, and other law enforcement and professional agencies to sort through the information, statements, scientific evidence, and findings of this case.
The Criminal Investigations Division Lead Supervisor, Sgt. John Allen and his investigative team have been examining the information received to date and are working closely with the State Attorneys Office to make a determination on the best way to proceed with the case based on the review and totality of the evidence.
Reports have been made regarding the expected course of action in the days to come; the Orange County Sheriffs Office has no additional information to share regarding this news report. We will not project our intended actions; any decision to move forward as reported will be the purview of the State Attorneys Office and their scope of response when they deem it appropriate and we will not respond on their behalf.
Investigators will continue to sift through and follow up on information that is deemed credible.
How can prosecutors get an indictment or build a case without a body?
A criminal defense specialist said the ingredients are all there.
“A lot of people think you need a body but its not true,” said Richard Hornsby, Attorney and President of the Central Florida Association of Criminal Defense Lawyers. “Every year you have cases where people are prosecuted and they are convicted and get the death penalty where no body is found but you have clear proof that someone died.”
Hornsby said he is unsure whether the trunk air samples would be admissible in a Florida court but the other evidence is key.
“If they found decomposition or bodily fluids in trunk and they link that to Caylee Anthony; if they do that they have a very strong case that Caylee died,” he said. “There would be a very strong case that Casey at least contributed to the death which would support a manslaughter charge.”
The grand jury is set to convene next week. Caseys attorney Jose Baez, through his publicist, said they won't say a word until an indictment is official.
Possible homicide or murder charges expected next week
The state attorney’s office and the Orange County Sheriffs Office are working together in a possible bid to file murder charges against Casey Anthony, although they have not formally filed any charges yet.
A grand jury is convening in Orange County next week and the evidence could be presented to that grand jury although there is no word or confirmation that the sate attorney will do so.
Earlier Wednesday, the Sheriff's Office released hundreds of additional pages of discovery related to the Casey Anthony case.
The documents focus on Casey's check fraud charges and include various evidence related to those charges. The discovery included surveillance photos of Casey Anthony fraudulently using her former friend, Amy Huzienga's, Bank of America bank account.
